American Lawyer posed the question this week, saying: If Musk can rattle world leaders with just a few words on X, what could the consequences be for Big Law firms, with whom he has enjoyed uneasy, awkward, at times tempestuous relationships?
Certainly conflicts with major law firms have been tumultous and often bitter often resulting in public disputes and severed relationships.
- For instance, Cooley LLP had issues when Musk reportedly pressured Tesla to fire an associate at Cooley LLP who had previously interviewed him during an SEC investigation. The firm refused, but it led to Tesla cutting ties with the firm.
- Perkins Coie was another in the Musk firing line when he publicly criticized Perkins Coie for its alleged involvement in the “Russia hoax” and urged companies to avoid using their services as well as disparaging the law firm, including in a May tweet that said Perkins Coie is made up of “white-shoe lawyers” who “thrive on corruption.“
- Quinn Emanuel has had a long-standing relationship, Musk’s company SpaceX fired Quinn Emanuel from a case, reportedly due to the firm’s representation of Twitter in a separate lawsuit against Musk.
Last year he also attacked class action law firms and opposing counsel in a securities trial following 2018 tweets stating that he had secured funding to take the electronic vehicle company private.
And there there are claims against his General Counsel at X. As AmLaw reported: . . the GC of what was pre-Musk Twitter and its ex-legal chief joined two other former executives to sue Musk for around $129 million, claiming he schemed to bilk them out of their contractual severance to save $200 million after buying the site in 2022.
“Because Musk decided he didn’t want to pay plaintiffs’ severance benefits, he simply fired them without reason, then made up a fake cause and appointed employees of his various companies to uphold his decision,” their complaint said.
Musk’s legal battles and disagreements with law firms appear to be ongoing. His animus towards lawyers can carry the sort of weight only a multi-billionaire and major social platform owner could wield.
And that is massive.
- He continues to express skepticism towards the legal profession, often criticizing lawyers and law firms on social media.
- His acquisition of Twitter (now X) led to numerous legal challenges and disputes with the company’s former legal team.
